Under Law 2294 of 2023, hydrogen produced from self-generated electricity derived from non-conventional renewable energy sources (FNCER), in conjunction with electricity from the National Interconnected System (SIN), qualifies as green hydrogen. This qualification is contingent upon the condition that the self-generated FNCER energy supplied to the SIN equals or exceeds the energy consumed from the SIN. Consequently, the emission factor becomes a critical criterion for certifying hydrogen as renewable or low-emission. For instance, to restrict emissions from hydrogen production to 2 kg CO2-eq/kg H2, the emission intensity of grid electricity must not exceed 40 g CO2-eq/kWh.
