First round for the allocation of temporary occupancy permits over maritime areas

Through the Roadmap for the deployment of offshore wind energy in Colombia, built jointly by the Ministry of Mines and Energy and the World Bank, a generation potential of 50 GW developable in the country was identified. This is a bet on decarbonization, security, firmness and reliability for the national energy matrix.

It was necessary to establish a regulation that would allow the sustainable, transparent and effective use of maritime resources in order to deploy these projects.

All this motivated the formulation of the first round for the allocation of temporary occupancy permits for maritime areas through the guidelines contained in Resolution 40284 of 2022 - MME / DIMAR.

Objective

In addition to creating a great energy complementarity, offshore wind represents opportunities for logistic and port development, transfer of capacities and investments that can be translated into benefits for the country. For all these reasons, the Government seeks to execute in the short term the first round of allocation of temporary occupancy permits for offshore areas that will make commercial wind projects viable and thus move on to the concession process for their construction and operation.

Available areas for project development

Through the coastal marine planning methodology carried out by the General Directorate for Maritime Affairs (DIMAR) -whose function is to coordinate, control and authorize maritime and coastal activities in the country- some areas with low conflict rates and adequate levels of coexistence between marine activities, the marine environment and offshore wind energy projects were determined.

As a result of this exercise, the central Caribbean zone was defined as the set of areas that would be offered in the first round of allocation of temporary occupancy permits described in Resolution 40284 of 2022.

Phases of the process

The following is a list of the phases of the process for the allocation of temporary occupancy permits for maritime areas.

Contents of the temporary occupation permit

DIMAR will establish and publish the content of the administrative act that grants the Temporary Occupancy Permit prior to the publication of final specifications by the process administrator.

Publication of the specific bidding documents and terms and conditions

The administrator will publish the bidding documents, which must have te preliminary no objectionof the DIMAR and the Ministry of Mines and Energy.

Qualification

Participants must prove compliance with the established requirements.

  • Financial qualification
  • Legal qualification
Area nomination

The qualified bidder may propose a new area different from those defined by DIMAR. Such area may not exceed 270 km2.

Submission of bids

Technical information on the executionof the project and additional information on the bidder's experience.

Evaluation and selection

Temporary occupancy permits will be assigned according to the qualification obtained by each bidder and the preference indicated by offered and nominated areas.

Formalization of the award

The result of the competitive process will be the granting of the Temporary Occupancy Permit on the maritime areas in charge of DIMAR.

  • Maximum duration: 8 years.
  • Activities related to measurement and collection of information to establish project feasibility.
Follow-up

The auditors will be selected by DIMAR and the cost of the audits will covered by the awarded bidder. DIMAR.

  • Inspections to the execution of activities.
  • Milestone compliance audit reports according to the schedule presented in the bid, every 6 months until FPO.
